Kochi: The Kerala High Court has declined to grant an interim stay on the state government's decision to dissolve the existing Waqf Board and constitute a new board. The order was issued on a petition filed by former Waqf Board chairman K.S. Hamza, who challenged the government's decision. The High Court considered the matter during a special sitting and referred the petition to a Division Bench for further consideration.

Hamza had approached the court seeking a stay on the government's decision to reconstitute the Kerala Waqf Board. In his petition, he argued that the new board had not been constituted in accordance with the relevant central legislation.

**High Court Declines Interim Stay**

The High Court's Single Bench admitted the petition but refused to suspend the government's decision. According to the court's interim order, there were no sufficient grounds to grant a stay at this stage. The court subsequently referred the petition to a Division Bench for further consideration. The refusal to grant interim relief means that the newly constituted Waqf Board is not prevented from proceeding with its activities under the challenged government order.

Had the court granted the requested stay, the new board would have faced restrictions on continuing its functions. The interim decision therefore comes as a relief to the state government, although the legal challenge to the reconstitution remains pending.

Petition Filed After Appointment of New Chairman**

The legal proceedings followed the state government's order appointing Muslim League leader M.C. Mayin Haji as chairman of the newly constituted Kerala Waqf Board. Following the appointment, K.S. Hamza, who had served as chairman of the board during the previous Left Democratic Front (LDF) government's tenure, approached the High Court. Hamza questioned the legality of the government's decision to dissolve the existing board and form a new one. His principal contention was that the reconstitution had not followed the provisions of central law.

Special Sitting Held During Court Holidays

The High Court conducted a special sitting to consider the petition because the court was scheduled to remain closed for consecutive holidays.

Given the urgency raised in the petition, the matter was taken up despite the holiday schedule.

After hearing the request for interim relief, the Single Bench declined to stay the reconstitution and transferred the petition for consideration by a Division Bench.

The court's decision allows the newly formed board to continue its functions for now, while the questions raised by the former chairman remain subject to further judicial examination.

The High Court has not issued a final ruling on the legality of the Kerala Waqf Board reconstitution.
